ad:tech San Francisco: Affiliate Marketing – The Big Challenges
Session Description: As the affiliate marketing industry grows, it continues to encounter challenges on multiple fronts. One front burner issue for brands and advertisers remains affiliate legislation. From New York to California to Texas, the nuances of tax collection in each state are still being worked out and, in many cases, litigated. With this vital issue still in flux, what are brands and marketers doing to move forward? How can advertisers keep track of the state-by-state laws, and how can they develop strategies for today and for the future? Trademark legislation is also a key issue for affiliate marketing and we’ll explore how brands walk the fine line between protecting their brand and getting wider exposure. Finally, we’ll tackle how affiliate legislation in various states will impact all online retailers.

- What does it mean for merchants?

- More than 20% of all Internet traffic is typed in.
- 15-30% of the time the URLs are misspelled.
- Companies often classify this as a legal issue instead of a marketing or traffic issue.
- Defending yourself against a typosquatter is expensive when you get lawyers involved.
- URDP – uniform domain name dispute resolution policy.
- Trademark infringement considered anything confusingly similar. Typos don’t count but content does. $1500 to file a complaint in court.
- You’re not filing against the domain name, you’re filing against the domain owners.
- Turn trademark enforcement into a profit center.
- Laws are international, but more enforceable on .com & .net.
- Marketing channels are business tools. Each should be employed for a specific purpose.
- You’re obligated to police your brand – your trademark can get canceled if you don’t prove you’re actively policing infringements.
- Learning from KEEN Footwear.
- Be sure your affiliates understand what affiliate marketing is.
- Affiliate publisher joined, tried selling his own brand of shoes thinking affiliate meant an endorsement similarly to the definition of “affiliate” in the TV world. Eventually showed up at the corporate offices demanding Keen CEO do more to leverage their partnership in trying to sell is shoe related product.
- Not all publishers understand what the channel is. Educate them.
- Be sure to clearly define all legal aspects.
- 20% of your affiliates are driving the majority of the revenue.
- What can you do to measure impact of amazon tax:
- Monitor legislation in states crucial to your success.
- Join the PMA to help.
- Stay informed through geekcast.fm, ReveNews.com, PMA blog.
- Create a contingency plans with a different payment or advertising model to not loose these valuable partners.
- Garbage can bills popping up including more junk trying to get out-of-state retailers to collect sales tax. Just says “don’t do business in our state”.

Tuesday January 19th
The final day of Affiliate Summit started bright and early with the Pinnacle Awards scheduled before the last day’s keynote by Brian Clark. This was a change for the conference agenda, which usually puts the Pinnacle Awards in the afternoon after other sessions. I like the change because it gets the awards out of the way, and didn’t interfere with any other sessions or independent parties planned in the evening. I seem to remember last year that some of the award winners had to jet quickly after the awards to get to a charity poker tournament, among other places.
The winners have been blogged all over, but here’s a quick recap just in case this is the only blog you read (unlikely): Affiliate of the Year – Nicholas Koscianski. Affiliate Manager of the Year – Matt McWilliams. Exceptional Merchant – eBay Partner Network. Affiliate Marketing Advocate – Angel Djambazov. Best Bloggger – Jeremy Schoemaker. Affiliate Marketing Legend – Scott Jangro.
Next up was Brian Clark’s keynote. He admitted at the beginning that it was his first keynote, so I guess he did pretty well all things considered. Of course, I have a whole post devoted to the keynote that I’ll go into later.
Once again, I intended to go into more sessions on Tuesday, but got sidetracked with all the networking possibilities. As well, I was given a demo of a new affiliate network of sorts, Impact Radius. It gives merchants and affiliates a way to also reach out and work with more traditional media partners. I had an opportunity to interview one of the founders, Lisa Riolo, about the launch of the new network, which will also be another blog post coming up soon.
I made it a point to get to Jim Kukral’s session How To Get Motivated For Success!, which I’ll of course be posting a recap for. It was a great kick in the pants to get going with projects that have been stalled for awhile. I know Eric Nagel wrote an entire post about Jim’s kick in the ass.
While in Jim’s session, I heard via Twitter that Daniel M. Clark of Geek Dads Weekly was invited to speak on the GeekCast.fm Live panel. I was bummed since I wanted to participate with that panel/group like I did at Affiliate Summit East 2009, but happy for Daniel. I went into the session for a moment, but left in favor of running back up to my room for a few things. As I understand, the session was some industry talk followed up with a lot of “how to podcast” type questions, so it looks like I personally didn’t miss much information that I didn’t already know.
The evening ended with a fail on the part of the Rio. A BlogUp mixer was planned at the VooDoo Lounge, which was official and everything, not just 100 people crashing the lounge for a mixer. Unfortunately, it was raining and since the lounge has an indoor and an outdoor area, the lounge ended up double booked with another much larger group of people. So we tried cramming into the bar at the steakhouse for awhile, overwhelming the poor bartender on duty. Finally, the Rio moved the charade down to the iBar and served complimentary champagne as a mea culpa.
I stayed for awhile, the it was on to another Las Vegas tradition – the buffet! A large group of us went to the Carnival World Buffet at the Rio, one of my favorite buffets ever. Then again, I haven’t been to many. It was good times and good food with good people – one of my favorite activities! After dinner, I went and hung out with Heather Smith & Julie Vazquez, who were still at the iBar. Had a very pleasant last night of Affiliate Summit West 2010!

Anyone who follows me on Twitter (if you don’t yet – what’s your excuse?) could see that I was more than making up for my lack of internet on my laptop by tweeting notes from the sessions I was in. - Video session: Youtube is larger than Microsoft in search engines- 77mil uniques

- .tv traffic increasing but still nowhere near as high as .com
- very brand & vertical specific video creative is the most requested
- People buy from people – at the end of the day video is the most effective medium for that. Amen!

By writers that kill! But it’s important to remember, as noted in my notes below, that content isn’t just the written word. It’s pictures, videos, widgets, everything. The panel consisted of:
- Lisa Picarille, Publisher & Editor-in-Chief, Revenue Magazine (Moderator)
- Angel Djambazov, OPM, Custom Tailored Marketing
- Kim Rowley, Founder, Key Internet Internet Marketing, Inc.
Overall it was a great panel, and Lisa did really well as a moderator despite unfortunately loosing her voice between last night & this morning.
Bullet Point Review!
- People want to write but they’re generally intimidated when they don’t have the “education” to do so.
- Passion & a unique voice are key.
- Ask yourself: how am I going to constantly update the readers & provide something new?
- Know your audience and craft your message.
- Ask your users for submissions.
- Contests are great – sometimes merchants will give you freebies to give away for the exposure & talking them up.
- Readers can tell the difference between reviews that are genuine and reviews that are written just to make a buck (hint: usually they’re overly talkin’ them up).
- Content isn’t just the written word, it’s also pictures, UGC, videos.
- Engage your audience & it will create content & ideas.
- Ask questions to engage readers.
- Be sure your ads contribute to your overall message – example given was a site for memorials for loved ones who’ve passed on with a banner ad for a popular dating service. Message FAIL.
- Design does contribute to the content, and can make it “seem” better.
- The design sets the tone for the content – a good example is TheDailyCandy.com – the design is fun & so is the content.
- Have some content that’s controversial…sometimes it gets more hits.
- Ping.fm is a great aggregate that lets you post across MANY social networks at once.
- Create an affinity with your audience.
- How do you get help? Ask knowledgeable family members, friends, users, and a professional outsource if necessary.
- What makes content the most compelling? Angel says be organic & open, be yourself, have some humor, & give a takeaway. Overall, be consistent! His example was Chrisbrogan.com.
Points brought up during the Q&A
- Keep video to 2-3 minutes max to keep attention – unless you’re damn compelling.
- Stories are better than iteration of tech knowledge.
- You need to get specific with your niche.
- Promote new blogs to the readers of your current blog.
- Passion resonates.
- Archives need to be accessible and easy – if I just found you & really like your blog, I’ll want to see what you’ve written about before.
- Effective to use analytics to understand how your audience interacts with you. It helps narrow down the sweet spot of your topic.
- Use WordPress plugins to your advantage to highlight the most popular posts.
- ShareThis is a great tool.
